On December 21, 2021, the Order of the Minister of Labor and Social Protection was issued regarding the approval of the checklist for state control in the field of labor relations.
The new checklist also includes information on the persons subject to control required for the risk assessment, the list of questions for the state control (68 questions in number), the score for the risk assessment, etc.
With the entry into force of the new checklist for state control in the field of labor relations, the old list approved by Order no. 102/2021 was repealed.
If during the control the violations in the field of labor relations are determined, a fine from 150 to 240 conventional units (7500 to 12000 lei) may be applied to the person in charge, with a fine from 260 to 400 conventional units (13000 to 20000) for the legal person.
The fine is applied applied for each separate violation.
Recommendation: Inform the persons in charge of human resources of the provisions of the new Order and provide a template of the new form (here).
