On October 15, 2021, the amendments made to the Execution Code entered into force.
The new changes generally aim to ensure better protection for debtors in enforcement proceedings.
Among the new provisions is, for example, the prohibition of pursuing real estate with the residential destination where the debtor has established his/her domicile, provided that the debtor and the spouse, minor child, or dependent person of the debtor do not have another home with the title of property or use, and the value provided in the enforcement documents according to which it is seized does not exceed 12 average salaries per economy.
Also, in the future, it will not be possible to follow the part of the debtor’s salary in the amount of the minimum guaranteed amount of the wage in the real sector, with the exceptions provided by law.
Recommendation: Employers responsible for the payment of salary must apply the new provisions of the Execution Code from the date of entry into force of the law, without the need for acts of disposition from bailiffs.
