On May 21, 2021, the so-called prevention law came into force.
The law aims to emphasize the obligation of control bodies to provide advisory support to entrepreneurs to avoid violating the law.
The control bodies will, in particular, have to publish on the official websites high-frequency cases, typical infringements found, case-by-case recommendations and prescriptions, materials, and guidelines on the rights and obligations of persons subject to control.
Another important aspect is the obligation of the control bodies to draw up plans to remedy the breach of the law. The remediation plans are an annex to the violation report. The inspector who identified the contravention will recommend the remedial measures and the deadlines for their implementation to comply with the requirements of the legislation.
In case of drawing up a remediation plan, no sanctions will be applied to the economic agent until the expiration of the term for remedying the violations.
