On November 11, 2021, the so-called law on the digitalization of the national economy was adopted.
The law adjusts about 30 normative acts to overcome the existing constraints that limit the possibilities of digital interaction.
Among the areas covered by the new law are issues related to the creation of profiles from the perspective of personal data protection.
The creation of profiles for the purposes of the new law is to be understood as the operations of the use of personal data in order to assess certain aspects relating to an individual, in particular to analyze or establish aspects of performance at work, economic situation, the health, preferences, interests, reliability, behavior, location and movements of the person.
Recommendation: Consider the option of conducting a data protection impact assessment if the operations you perform involve forms of automatic processing of personal data, including profiling.
