On January 1, 2022, the new restrictions on gambling advertising came into force.
With the entry into force of Law no. 195/2021, any form of advertising for the promotion or stimulation of gambling (including online gambling), betting on sporting events and other gambling activities, including radio and television advertising, is prohibited in written press, in cinematographic and video services, via the Internet, with the use of telephone and telegraph networks, in the outdoor and indoor advertising in closed and semi-closed public spaces, advertising in or on means of transport and by mail.
It is also forbidden for economic agents carrying out gambling activities to initiate or to participate in sponsorship or philanthropic activities following which the name of the economic agent who organizes, carries out or operates gambling, betting for competitions / sporting events and other gambling activities may become visible or other information about its relationship to the event becomes advertising.
The fine in case of violation of the requirements of the law may amount to a fine on legal entities in the amount of 200 to 300 conventional units (10,000 to 15,000 lei) with deprivation of the right to carry out certain activities for a period of 6 months to one year.
Recommendation: If you are involved in the business of gambling, bring the provisions of the new law to the attention of those in charge to assure compliance with the rules of the direct and indirect advertising.
